These Terms and Conditions (T&C) apply to all rental agreements for holiday apartments concluded via the platform trimosa.debetween the renter (hereinafter referred to as "Guest") and TRIMOSA Apartments & Homes eGbR, Feldkirchener Str. 18a, 85622 Weißenfeld (hereinafter referred to as "Landlord"). Any deviating conditions of the Guest shall not be recognised unless the Landlord expressly agrees to their validity in writing.
The presentation of accommodations on the platform does not constitute a legally binding offer, but rather an invitation to submit a booking. Depending on the accommodation, two booking methods are available:
a) Instant booking: Upon completion of the booking process and successful payment, the rental agreement becomes binding.
b) Booking enquiry: The Guest submits a non-binding enquiry. The rental agreement only comes into effect upon explicit confirmation by the Landlord. If the Landlord rejects the enquiry, any amount already paid shall be refunded in full.
Which booking method is available for an accommodation is indicated in the respective listing.
Information on electronic business transactions (Art. 246c EGBGB): Booking takes place in these steps: (1) Selection of accommodation, period and number of guests in the booking box; (2) Click on "Book now" or "Send enquiry" – without a customer account, the contact details form opens first, with a customer account a complete profile (name, address) is required; (3) Review of all information and the total price; (4) Another click on "Book now" or "Send enquiry" redirects to payment with payment service provider Stripe; (5) For an instant booking, the contract is concluded upon successful payment; for an enquiry, it is only concluded with confirmation by the landlord (see above). Input errors can be corrected in the booking box fields at any time before forwarding to Stripe; the process can be cancelled free of charge on the payment page.
The landlord stores the contract text (booking data, total price, cancellation terms). Booking data, total price and cancellation terms are sent to the guest with the booking confirmation by e-mail; the booking can also be accessed at any time in the guest area under "My trips". These terms and conditions are available in their current version at trimosa.de/agb and linked in the booking confirmation; the guest can save or print them there. The contract language is German; translations of the platform into other languages are for information purposes; in case of doubt, the German version applies. The landlord has not subjected itself to any special codes of conduct.
The prices stated in the respective listing at the time of booking apply. The total rental price is – unless expressly agreed otherwise – due in advance and is processed online by credit card via our payment service provider Stripe. The rental price is inclusive of statutory VAT.
The cancellation policy is governed by the cancellation policy specified in the respective listing and displayed to the guest before completing the booking. Accommodations may be subject to different policies (e.g. flexible, moderate or strict); the policy displayed and confirmed for the specific booking is always decisive.
A timely cancellation results in a refund in the amount provided for under the respective policy. Refunds are made via the same payment method used for the payment.
There is no statutory right of withdrawal for the rental of holiday apartments for a specific date or period in accordance with § 312g para. 2 no. 9 of the German Civil Code (BGB).
The rental duration is specified in the booking confirmation. Check-in and check-out times are in accordance with the times specified in the respective listing. An extension of the stay is only possible with the prior consent of the landlord.
The holiday apartment must be treated with care. The house rules specified in the respective listing apply (including smoking, pets, quiet hours and events). Any damage caused by the guest or accompanying persons must be reported to the landlord immediately and must be compensated by the guest. The accommodation may only be used by the number of persons specified in the booking. Subletting or transfer to third parties is prohibited.
The landlord is liable for damages only in cases of intent or gross negligence. In the event of a breach of essential contractual obligations (cardinal duties), the landlord is also liable for simple negligence, but this is limited to contract-typical, foreseeable damage. Liability for damages arising from injury to life, body or health remains unaffected. Liability for disruptions to water, electricity or internet supply as well as for events of force majeure is excluded. No liability is accepted for guests' personal belongings.
The landlord is entitled to cancel the contract for good cause, in particular if the holiday apartment is not usable due to unforeseen circumstances (e.g. damage, force majeure). In this case, the rental price already paid will be refunded in full. The guest has no further claims, in particular no claims for damages.
Personal data of the guest is processed exclusively in accordance with applicable data protection laws. Details are contained in our Privacy Policy.
Should any provision of these Terms and Conditions be wholly or partly invalid or become invalid, the validity of the remaining provisions shall remain unaffected. The law of the Federal Republic of Germany applies.
